QUESTION:

Are the members of the North Brevard County Public Library District Board public officers within the meaning of that term as found in part III, Ch. 112, F. S. (1974 Supp.), and therefore subject to disclosure provisions applicable to public officers?

Your question is answered in the affirmative.

Enclosed please find a copy of a previous opinion of this commission, CEO 74-36, the rationale of which is equally applicable to your question. Your inquiry is answered accordingly, inasmuch as the powers and authority of the North Brevard County Public Library District Board, as set forth in Ch. 69-869, Laws of Florida, are regulatory and policymaking in nature.
